12. Governing Law and Jurisdiction
These Terms of Use shall be governed by the law of the Hong Kong Special Administrative Region. You agree to submit to the non-exclusive jurisdiction of the Hong Kong courts.
HKSTP Logos Usage
All users of HKSTP Logos are required to submit your request via HKSTP Logos Usage Request Form to obtain prior authorization from HKSTP.
Approval of the application for the use of the Logos (“Approval”) is subject to the sole and absolute discretion of HKSTP, and submission of the Form does not constitute an Approval. Approval may or may not be subject to conditions to be imposed by HKSTP.
Terms and Conditions
1. The Logos are the sole property of HKSTP, and shall not be used without prior written authorization of HKSTP. Authorization to use the Logos is restricted to the applicant named in this Form. The applicant must duly complete all fields and submit the Form to HKSTP at least five working days prior to the proposed first day of use of the Logos as specified in this Form. HKSTP may, at its option, take legal action for any use of the Logos without Approval and/or fulfillment of conditions to be imposed on the Approval without prior notice.
2. HKSTP shall be entitled to immediately terminate, revoke, modify or suspend the Approval and any rights arising out of or in connection with the Approval (including the imposition of condition(s)), in whole or in part, without cause, liability, compensation or prior notice, and HKSTP may exercise such right at its sole and absolute discretion at any time.
3. Approval will only be granted on a project basis and the name of such project shall be identified in the Form. The Logos shall under no circumstances be used for or attached to other projects/ programs, initiatives, or uses without specific prior written consent or Approval of HKSTP. The applicant must immediately cease to use the Logos and all materials containing the Logos, as well as remove and delete the Logos from all their properties and media, including but not limited to their electronic records, after the applicant completes, terminates or withdraws from the project as specified in the Form.
4. By making the application, the applicant agrees and undertakes, inter alia:
to, if Approval is granted, observe and be bound by the terms and conditions hereof, the Corporate Identity Guideline as set out in the Appendix, and such amendments thereto made by HKSTP from time to time. ;
that HKSTP is entitled to terminate any prior approval of the use of the Logos by the applicant without any liability or compensation;
to immediately cease the use of the Logos on/upon (i) the end date of the project as set out in the Form, (ii) completion of the project, (iii) termination of the project, (iv) withdrawal from the project, or (v) request of HKSTP, whichever is the earlier;
to submit the final layout of materials proposed to use the Logos to HKSTP for approval not less than 2 working days prior to the publishing of the material(s) and not to publish or otherwise use any material(s) bearing the Logos without HKSTP’s specific prior written approval. Such approval shall be granted by HKSTP at its sole and absolute discretion; and
that the Form, the terms and conditions hereof together with the Appendix shall be subject to and construed according to laws of the Hong Kong Special Administrative Region and to submit to the exclusive jurisdiction of Hong Kong courts.

HKSTP OnePass Terms and Conditions
General Terms and Conditions
These General Terms and Conditions of HKSTP OnePass (“Terms and Conditions”) apply to all users of OnePass, the centralized registration and login platform (“OnePass”) operated by Hong Kong Science and Technology Parks Corporation (“HKSTP”). By accessing or using OnePass, registrants and users agree to be bound by these Terms and Conditions, as amended from time to time.
Eligibility
- Eligibility – Any individual aged 18 or above who meets the user application requirements as may be prescribed by HKSTP from time to time (“User”) shall be eligible to apply for application as a User of OnePass.
- Usage – OnePass is a portal operated by HKSTP to centralize registration and login access to different HKSTP services including but not limited to different applications and functions (“HKSTP Applications”) through a single set of login credentials either through email, mobile number or social account login. A User’s access rights to the various HKSTP Applications shall be determined by HKSTP on a case-by case, -as needed basis, and shall at all times- be subject to the applicable terms and conditions governing each relevant HKSTP Application. Discretion to Decline – HKSTP reserves the absolute right, in its sole discretion, to reject any application for User registration as it deems fit.
Registration and Log-in
- Email Login – Users can log in using their registered email address and password through HKSTP OnePass to gain access to the various HKSTP Applications.
- Mobile Number Login – Users can log in using their registered mobile number and a one-time passcode (OTP) sent via SMS to gain access to the various HKSTP Applications.
- Social Account Login – Users can log in using their preferred social media account to gain access to the various HKSTP Applications.
- Guest Account – Users can access selected HKSTP Applications as a Guest via HKSTP OnePass for a limited period of time. After this period expires, the guest account will be removed, and any associated access or data may be lost once the account expires or access is revoked.
Termination or Suspension of User
- Right to Suspend or Terminate the OnePass platform – HKSTP may, at its sole and absolute discretion and for any reason (including but not limited to commercial considerations), suspend or terminate OnePass, in whole or in part, or cease its operation entirely. HKSTP shall not be liable to any User or any third party for any loss, damage, or consequence arising from such suspension, termination, or cessation.
- Right to Suspend or Terminate User’s OnePass – HKSTP may, at its sole and absolute discretion and with immediate effect, terminate or suspend a User’s OnePass for any reason whatsoever, including without limitation: (i) if the User breaches any of these Terms and Conditions or fails to comply with any reasonable instructions issued by HKSTP from time to time; (ii) if HKSTP reasonably suspects that the User has engaged in, is attempting to engage in, or is otherwise connected with any activities that may be unlawful, fraudulent and/or unauthorized (e.g. misrepresentation, misuse of the platform, engaging in cyberattacks on the OnePass platform, infringement of intellectual property rights, or violation of applicable laws and regulations). HKSTP shall not be liable to any party for any loss or damage arising from any such termination or suspension of a User’s OnePass.
- Without Prejudice to Other Rights – Any termination or suspension of a User’s OnePass, for whatever reason, shall be without prejudice to any rights or remedies accrued to HKSTP against such User prior to termination or suspension.
- Death of User – A User’s OnePass shall automatically terminate upon the death of the User.
Disclaimers
- Exclusion and Limitation of Liability – To the fullest extent permitted by law, HKSTP, its employees, affiliates, agents, and suppliers disclaim and limit any liability arising under these Terms and Conditions, whether such liability is expressed or implied by statute, common law, or otherwise.
- Waiver of Rights – Each User is deemed to have agreed to these Terms and Conditions and acknowledges that no reliance has been placed on any statement, representation, assurance, or warranty of HKSTP or its personnel, except as expressly set out herein. The User irrevocably waives all rights or claims against HKSTP arising from any such matters not expressly contained in these Terms and Conditions.
- Fit for Use – HKSTP makes no warranty, representation, or guarantee as to the quality, suitability, or fitness for purpose of any HKSTP Platform Function. HKSTP shall not be responsible or liable for: (a) any refusal by HKSTP to provide any such function or service; or (b) any unavailability, interruption, or suspension of any such function or service.
- Terms and Conditions of the HKSTP Platform Functions – Each HKSTP Platform Function may be subject to its own additional terms and conditions applicable to the User. By accessing or using any such Platform Function, the User agrees to comply with and be bound by all such additional terms and conditions governing the relevant Platform Function.
Right of Modification
- Right to Modify – HKSTP reserves the right, at any time and without prior notice, to modify, alter, or update the structure, content, features, or functionality of OnePass (or any part thereof), including but not limited to the conditions and requirements for registration and login.
General Provisions
- Right to Transfer – HKSTP may, at its discretion, transfer, assign, sub-contract, or otherwise deal with any of its rights or obligations under these Terms and Conditions and OnePass on such terms as it considers appropriate and may do so at any time without prior notice to the User.
- Right to Amend – These Terms and Conditions are subject to change from time to time. Please visit the website for the latest version of these Terms and Conditions.
- Right to Interpret – Interpretation of any of these Terms and Conditions is the sole prerogative of HKSTP. All decisions by HKSTP regarding the interpretation of these Terms and Conditions and any issues arising from the use of OnePass shall be binding and conclusive.
- Governing Law – These Terms and Conditions shall be interpreted and construed in accordance with the laws and regulations of the Hong Kong Special Administrative Region of the People’s Republic of China (“Hong Kong”) and any disputes shall be subject to the non-exclusive jurisdiction of the courts of Hong Kong.
HKSTP OnePass Wi-Fi Terms & Conditions
The followings are the terms and conditions (these “Terms and Conditions”) for accessing wireless LAN network through HKSTP OnePass (defined below)
Overview
- Hong Kong Science and Technology Parks Corporation (“HKSTP”) has established the HKSTP OnePass account management service which is available for the HKSTP Spark Members and public users. HKSTP OnePass is a unified user account to access various services provided by HKSTP and partnered Service Providers (“SPs”).
- HKSTP has engaged various SP to provide users of HKSTP OnePass (the “Users” each “User”) with wireless LAN access to the Internet both within Science Park and outside Science Park (where available) (the “Service”). Any use of and/or access to the Service shall constitute your agreement to be bound by these Terms and Conditions including (a) SPs Terms and Conditions (defined below) and (b) any changes to these Terms and Conditions made by HKSTP from time to time.
- PRIOR TO PROCEEDING FURTHER AND USING/ACCESSING THE SERVICE, YOU MUST AGREE WITH AND PROVIDE YOUR CONSENT AND ACCEPTANCE TO THESE TERMS AND CONDITIONS. IF YOU ARE NOT IN AGREEMENT WITH THESE TERMS AND CONDITIONS, PLEASE DO NOT PROCEED FURTHER WITH THE ACCOUNT REGISTRATION.
Eligibility and Availability
Subject to the approval of HKSTP, all Users are eligible to use the entitled Service.
Free of Charge
Subject to these Terms and Conditions, the Service is provided to all Users free of charge.
Registration of the Service
User must complete the corresponding registration through HKSTP OnePass before using the Service which shall include but not limited to obtaining user name and password.
Representations and Warranties
Without prejudice to the generality of these Terms and Conditions, by using and/or accessing the Service each User represents, warrants and undertakes as follows:
- all information provided to HKSTP in relation to the Service is complete, accurate and truthful;
- to accept the Terms and Conditions and agree to be bound by the same; and
- to duly observe and comply with all laws and regulations applicable to the Service and these Terms and Conditions.
Any personal data (as defined in Personal Data (Privacy) Ordinance, Cap. 486) collected from you in relation to or through the Service will be subject to the privacy policy of HKSTP (“HKSTP Privacy Policy”) and/or applicable terms and conditions of SPs (“SPs Terms and Conditions”). HKSTP Privacy Policy and SPs Terms and Conditions can be found at .
In addition to HKSTP Privacy Policy, you agree that HKSTP may use or disclose any personal data furnished by you to any of the SPs for the purposes related to the Service.
Use of Service
By using and/or accessing the Service, each User acknowledges, accepts, agrees and/or undertakes that:
- each User shall not, or permit any other person to, send or attempt to send or cause to be sent, any commercial electronic message not in accordance with all applicable laws in any applicable jurisdiction;
- each User shall not resell, sub-license, assign or transfer your right to use the Service to any person by whatever means which shall include but not limited to sharing any user names and passwords obtained through HKSTP OnePass. Each User also undertakes to protect such user names and passwords from unauthorized use;
- each User shall not hack, break into, access, reverse engineer, use or attempt to hack, break into, access, reverse engineer or use any part of (i) the Service and/or any data areas on SPs’ servers for which you have not been authorised by SPs; and (ii) any web site of any third party for which you have not been authorised;
- each User shall not, or permit any other person to, send, publish, distribute, make available to other Internet users, transmit or circulate any material or content that is obscene, indecent, vulgar, pornographic, seditious, offensive, defamatory, threatening, liable to incite racial hatred, discriminatory, menacing, in breach of confidence, infringes or is likely to infringe any copyright, trademark, patent, moral right or other intellectual property right of any third party or in contravention of all the applicable laws in any applicable jurisdiction;
- HKSTP and/or SPs may, in their sole discretion and without liability to any User or any users, change, deactivate, withdraw, suspend or terminate any and all the Service and/or change these Terms and Conditions, with or without reason and/or notice to any User . Without prejudice to the generality of the other Terms and Conditions, HKSTP and/or SPs are entitled to terminate the Service if any User fails to comply with any provisions of these Terms and Conditions or is in breach of any applicable law in any jurisdiction
- HKSTP and SPs shall not be responsible or liable for any acts, omission, default or negligence of any User and/or any users (whether authorised or not) arising out of or relating to the use of the Service;
- any User shall not tamper, change or modify or in any other ways seek to or attempt to tamper, change or modify the SPs’ network;
- any User shall fully comply at all times with (i) the all law and regulatory requirements applicable to the use of the Service in any applicable jurisdiction; and (ii) all instructions, supplemental Terms and Conditions or guidelines as may be imposed by HKSTP or SPs from time to time. Each User further undertakes not to use or allow others to use the Service for any purpose which HKSTP and/or SPs consider(s) improper, immoral, defamatory, fraudulent or otherwise in contravention of the applicable law in any jurisdiction;
- any User must not, or permit any person to, use the Service to publish, post, upload, transmit, re-transmit, send, or circulate any software or other materials that:
a. contain any computer viruses, worms, software bombs, Trojan horse or other harmful or malicious computer instructions, devices or techniques that can or were designed to threaten, infect, damage, disable or shut down any telecommunications device or any component of a computer system;
b. contain any hidden files;
c. replicate, transmit or activate itself without control of a person operating the computing equipment on which it resides;
d. alter, damage or erase any data or computer programs without control of a person operating the computing equipment on which it resides; and/or
e. contain any illicit code;
- any User must not, or permit any person to, copy, encode, digitise, reformat, compress, intercept, interfere, or tamper with or otherwise manipulate the signals of the Service in any way and by any means;
- HKSTP and/or SPs may (although HKSTP and/or SPs are not obliged to do so) delete (in whole or in part) (i) any suspected spam messages and/or (ii) virus-infected files, messages, contents or any other materials, with or without notice to any User; and
- the SPs Terms and Conditions shall be binding on any all Users to the fullest extend. In the event of inapplicability, inconsistency or conflict, between Terms and Conditions and SPs Terms and Conditions, HKSTP shall have the absolute discretion to determine which term and condition or which part of the term and condition shall prevail. Reference to Terms and Conditions herein shall include SPs Terms and Conditions.
Deleting Account
What happens when you delete your account?
- When we receive your account deletion request, we will check what application(s) have been associated with your HKSTP OnePass account. The association may be established by you or your employer’s request.
- We will follow up and check with those associated applications maintainers before taking account deletion process.
- We will send you and/or your employer confirmation email about which associated application(s) will be involved in the deletion process.
- After getting confirmation, we will delete all your personal data on those application(s). You will not be able to access or recover any of your content after your account is deleted.
- We will also cancel any subscriptions, memberships, or purchases you made on our application(s). You will not be able to request a refund or a renewal after your account is deleted.
What are your responsibilities when you delete your account?
- You are responsible for backing up any content or data you want to keep before you delete your account. You are responsible for notifying any third parties that may be affected by your account deletion, such as your employer, contacts, or partners. We will not be responsible for any consequences or disputes that may arise from your account deletion.
- You are responsible for complying with any legal obligations or contractual agreements that may apply to your account deletion, such as the terms of service, privacy policy, or copyright policy of our platform or any other platform you used in connection with our platform. We will not be responsible for any violations or breaches that may occur from your account deletion.
How can you delete your account?
- To delete your account, please send out an email to ithelpdesk@hksciencepark.org, subject as “OnePass Account deletion” and provide your OnePass UserID or OnePass email address in email Content.
- Please note that the account deletion process may take up to 30 days to complete. After the account deletion process is completed, you will not be able to reactivate your account or create a new account with the same email address.

Disclaimer of warranties and limitation of liability
- Each User expressly acknowledges and accepts that (a) there are risks relating to the use of the Service and you shall assume all and any responsibility and liability related to the security, privacy and confidentiality risks arising out of or relating to the Wi-Fi and/or wireless communications and technology; (b) the Service is provided on an "as is" and/or "as available" basis (as the case may be); and (c) HKSTP and SPs do not make any warranty, undertaking, representation or assurance relating to the use of the Service.
- The Internet accessible via the Service may contain unedited or uncensored materials, some of which are unsuitable to minors or may be offensive to any users of the Service. Each User assumes all and any risk and responsibility associated with the use of the Service and the Internet accessible via the Service and each User is solely responsible for evaluating the accuracy, completeness, usefulness, quality and merchantability of all materials, data, information, contents, services, products or merchandise, provided through the Service and/or the Internet accessible via the Service.
- HKSTP and/or SPs do not warrant or represent that the Service will be uninterrupted, error-free, or free of computer viruses, worms, software bombs, hidden files, illicit codes, Trojan horse or any other harmful or malicious computer instructions.
- HKSTP and SPs make no express warranties and representations and to the extent permitted by law, each User waives all implied warranties and representations of HKSTP and SPs (including, without limitation, the warranties of title, non-infringement, merchantability, and fitness for a particular purpose) regarding any materials, data, information, contents, services, products or merchandise provided through the Service or the Internet accessible via the Service.
- No advice, data or information provided or statements made by HKSTP or SPs, their employees, agents, representatives or contractors shall constitute or is deemed to constitute a warranty, undertaking, representation or assurance whatsoever pertaining to the Service. Any statements made and any data or information provided in packaging materials, manuals or other documents of HKSTP or SPs are provided for your references only and shall not be regarded as warranty, undertaking, representation or assurance relating to the Service made by HKSTP and/or SPs, their employees, agents, representatives or contractors.
- Each User acknowledges and accepts that to such extent permitted by law, HKSTP and SPs, their affiliates, employees, agents, representatives or contractors shall not be liable for any action, claim, proceeding, demand, loss, damage, liability, charge, cost and expense whatsoever and however arising from the use of the Service and/or the Internet accessible via the Service by any User and/or any users (whether authorized by you or not). In particular, each User acknowledges and accepts that HKSTP and SPs, their affiliates, employees, agents, representatives and contractors expressly disclaim any and all liability for:
a. any indirect, special, economic, collateral, incidental, consequential or punitive loss or damage, whether in contract, tort, statutory or otherwise, suffered, sustained or incurred by any User or any person arising out of or relating to the Service. For the purposes of these Terms and Conditions, indirect or consequential loss or damage includes, without limitation, loss of revenue, profit, anticipated savings or business, loss, corruption or damage to data, voice or other information, loss of goodwill, loss of bargain, loss of opportunities, loss of use or value of any equipment and software, any third party claims, and, all associated and incidental costs and expenses;
b. any claim, loss or damage relating to any materials, data, information, contents, services, products or merchandise supplied, provided, sold or made available by or through the Service (or any failure or delay to so supply, provide, sell or make available);
c. any claim, loss or damage relating to any disruption, termination, suspension or degradation of the Service or any part thereof;
d. any claim, loss or damage which is attributable to a Force Majeure (as defined below) event; and
e. any damage to or loss of software and/or hardware installed in your computer, device or other equipment for the purpose of using the Service.
- Each User and/or any users is/are responsible for your own property and HKSTP and SPs will not be liable for any loss or damage to any or such property.
Indemnification
Each User agrees that it shall fully indemnify and hold HKSTP and/or SPs harmless on demand from and against all claims, actions liabilities, costs, expenses, loss or damage (including but not limited to consequential losses, loss of profit and loss of reputation and all interest, penalties and legal and other professional costs and expenses) (i) incurred by the HKSTP and/or SPs; and/or (ii) arising from or relating to (directly or indirectly) any default or any violation of any of such User’s obligations under these Terms and Conditions.
General provisions
- HKSTP reserves the right to cancel or make changes to the Service and HKSTP shall has the absolute discretion to review, approve and/or accept any user of the Service without any obligation to provide any reasons for any of its decisions. In the event that the Service is cancelled and/or changed for whatever reason, HKSTP will not incur any liability towards any party arising from such cancellation.
- HKSTP reserves the right to refuse any party’s access to the Service and to request any party to cease accessing the Service if in the sole discretion of HKSTP, such party (i) fails to comply with any of these Terms and Conditions; or (ii) is found to have behaved in an illegal or anti-social manner; or (iii) is found to have violated any of these Terms and Conditions. The decision of HKSTP in this regard shall be binding and conclusive.
- Any failure to provide the accurate information and/or information as requested herein may delay or invalidate the corresponding User’s access to or use of Service.
- Any User shall not be permitted to use the names and/or logos of HKSTP in any manner without the prior written consent of HKSTP.

- Any failure or delay on the part of HKSTP to enforce any of these Terms and Conditions shall not constitute a waiver of any of its rights herein.
- If any provision contained in these Terms and Conditions is found to be invalid or unenforceable by any court, the invalid or unenforceable provision shall be severed or amended in such a manner as to render the rest of the provision(s) and remainder of these Terms and Conditions shall remain valid and enforceable.
- Interpretation of any of these Terms and Conditions is the sole prerogative of HKSTP. All decisions by HKSTP regarding the interpretation of these Terms and Conditions and any issues arising from the Service shall be binding and conclusive.
- These Terms and Conditions shall be interpreted and construed in accordance with the laws and regulations of the Hong Kong Special Administrative Region of the People’s Republic of China and any disputes shall be subject to the non-exclusive jurisdiction of the courts of Hong Kong.
- The parties hereto do not intend any of these Terms and Conditions to be enforceable pursuant to the Contracts (Rights of Third Parties) Ordinance (Cap. 623 of the laws of Hong Kong).
- The termination of these Terms and Conditions and/or the Service shall not affect any accrued rights of HKSTP.

Event General Terms and Conditions
1. PRIOR TO REGISTRATION FOR THE EVENT, YOU MUST AGREE WITH AND PROVIDE YOUR CONSENT AND ACCEPTANCE TO THESE TERMS AND CONDITIONS. IF YOU ARE NOT IN AGREEMENT WITH ANY OF THESE TERMS AND CONDITIONS, PLEASE DO NOT REGISTER FOR THE EVENT.
In these Terms and Conditions:
- "Event" means any event, function, seminar, conference, exhibition booth, networking event, activity or related occasion organised, hosted or managed by the Organiser (whether by itself or with third party) which is, or may from time to time be, made available for registration under the required registration arrangements of the Organiser.
- "Organiser" means Hong Kong Science and Technology Parks Corporation
- "Participant" means any person who attends, registers for, or participates in an Event
- "Intellectual Property" means all patents, trademarks, copyrights, designs, confidential information, and all other intellectual property rights
- “Force Majeure Event” means any acts of God, war, insurrection, riot, civil or social unrest, sabotage, boycott, embargo, explosion, fire, earthquake, flood, unavoidable accident, the outbreak of any disease, virus epidemic, riot, public disorder, violent demonstrations, blockade, government regulations, legal proceedings, or any other similar events or circumstances.
- In interpreting the Terms and Conditions, words (1) importing a gender include any other gender; and (2) in the singular include the plural and vice versa.
2. REGISTRATION AND ADMISSION
2.1 Registration Requirements
All Participants must complete the official registration process as specified by the Organiser for the relevant Event (if required). Registration is subject to availability and to the Organiser’s sole discretion to accept or reject any application. Additional terms and conditions specific to a particular Event may also apply.
2.2 Eligibility
Participants must meet all the eligibility requirements specified by the Organiser for the relevant Event from time to time. By registering, Participants warrant that they meet all eligibility requirements.
2.3 Admission
The Organiser reserves the right to refuse entry or remove any Participant who:
- Does not hold a valid registration or ticket
- Breaches any of these Terms and Conditions
- Engages in disruptive, threatening, or offensive behavior
- Appears to be under the influence of alcohol or drugs
- Violates any applicable laws or regulations
2.4 Access Control
The Organiser may require Participants to present identification or proof of registration upon entry.
3. PARTICIPANT CONDUCT AND SAFETY
3.1 Code of Conduct
Participants agree to:
- Comply with all applicable laws and regulations
- Treat all attendees, speakers, staff, and volunteers with respect
- Not engage in harassment, discrimination, or abusive behavior
- Not bring prohibited items (e.g. weapons, drugs, hazardous materials)
- Not disrupt or interfere with the Event or other Participants
3.2 Health and Safety
Participants are responsible for their own health and safety. Participants with health concerns should consult their medical practitioner before attending.
3.3 Removal from Event
The Organiser reserves the right to remove any Participant who violates these Terms and Conditions without refund or compensation.
4. LIMITATION OF LIABILITY, RELEASE AND INDEMNITY
4.1 Participants attend the Event freely and at their own risk. The Organiser, its affiliates, divisions, subsidiaries, and all of their respective officers, directors, employees, contractors, representatives and agents (collectively the “Released Parties”) will have no liability whatsoever for, and will be released and held harmless by any Participant for any claims, liabilities, or causes of action of any kind or nature for any injury, loss or damages of any kind including direct, indirect, incidental, consequential or punitive damages to persons, including without limitation disability or death. Without prejudice to the generality of the foregoing, everything in connection with the Event is provided “as is” without warranty of any kind, either express or implied, including but not limited to, the implied warranties and merchantability, fitness for a particular purpose, and non-infringement.
4.2 You are responsible for your own valuables and the Organiser will not be liable for any loss or damage to any personal property brought to the Event.
4.3 Indemnity
Each Participant agrees that he/she shall indemnify and hold the Organiser and the Released Parties harmless on demand in full from and against all claims, actions liabilities, costs, expenses, loss or damage (including but not limited to consequential losses, loss of profit and loss of reputation and all interest, penalties and legal and other professional costs and expenses) suffered or incurred by the Organiser arising from or relating to (directly or indirectly) any breach or non-performance or non-observance of any terms, undertakings, warranties or representations under these Terms and Conditions by the Participant.
4.4 Insurance
Participants are advised to obtain their own travel and health insurance (if needed).
5. INTELLECTUAL PROPERTY, PUBLICITY AND RECORDINGS
5.1 Ownership of Content
All materials, presentations, content, and intellectual property created or presented at the Event remain the property of the Organiser and/or the respective creators or rights holders.
5.2 Photography and Recording
If so restricted by the Organiser, any unauthorized recording or distribution of photograph, video record, or audio record the Event (or any part thereo), live-stream or broadcast the Event or share recordings on social media or any public platform without the consent of the Organiser may result in legal action and immediate removal from the Event.
5.3 Publicity
You agree that the Organiser and its affiliates, partners and licensees may use, reproduce, edit, adapt, publish, display, communicate, distribute and otherwise exploit, in whole or in part, your name, likeness, image, voice, statements and any materials featuring you or your participation in the Event (including but not limited to all photos, pitch videos, live or recorded video or audio captures, screen captures, digital creations from such participation, and any other audio visual or photographic recordings of or taken at the Event) in any form and media, whether now known or hereafter developed, including but not limited to the HKSTP Gallery, websites, mobile applications, social media platforms, campus TV, online and offline publications, press releases, promotional campaigns, internal communications, presentations and marketing or publicity materials, worldwide and for unlimited duration, for the purposes of promotion, marketing, publicity, reporting or documentation of the Event and/or the activities of the Organiser, without any fee, royalty or other consideration payable to you. You waive any right to inspect or approve the final form of any such use and any moral rights (to the extent permissible under applicable law) in such materials.
6. REPRESENTATIONS AND WARRANTIES
Without prejudice to the generality of these Terms and Conditions, all Participants represent, warrant and undertake as follows:
6.1 all information provided in the registration form and in relation to the Event is complete, accurate and truthful;
6.2 he/she shall duly observe and comply with all laws and regulations applicable to the Event and/or these Terms and Conditions.
7. GENERAL RULES
7.1 The Organiser reserves the right to cancel or make changes to the Event. Should there be cancellations or changes, announcements will be made for example on event website, or via email notification(s) or any other reasonable means. In the event that the Event is cancelled for whatever reason, the Organiser will not incur any liability towards you arising from such cancellation or change.
7.2 The Organiser reserves the right to amend, vary, or modify the content, format, schedule, or other details of the Event at any time without prior notice.
7.3 The Organiser reserves the right to refuse anyone’s entry to the Event and to request any person to cease participating in the Event if in the sole discretion of the Organiser, such party (i) fails to comply with any of these Terms and Conditions; or (ii) is found to have behaved in an illegal or anti-social manner; or (iii) is found to have violated any of these Terms and Conditions; or (iv) fails to follow/comply with any directions/instructions/requests of the Organiser during the Event. The decision of the Organiser in this regard shall be binding and conclusive.
7.4 The Event may be recorded and/or used for internet streaming. By participating in the Event you are deemed to have provided your consent to the use of your actual or simulated likeness in connection with the production, exhibition, advertising or exploitation of any film, video and /or audio recording of the Event or any element thereof in any media of whatever form throughout the world. You also agree to being filmed/recorded through security cameras for the purpose of ensuring public security at the Event and preventing crime where applicable.
7.5 You shall not be permitted to use the names and/or logos of the Organiser in any manner without the prior written consent of the Organiser.
7.6 The Organiser shall not be liable for any delay, alteration, postponement or cancellation of the Event, or for any failure or delay in performing any of its obligations under these Terms and Conditions, to the extent that such delay or failure is caused by a Force Majeure Event. In the occurrence of a Force Majeure Event, the Organiser may, at its sole discretion, cancel, postpone, or modify the Event without any liability to Participants, save that any refund or credit (if any) shall be determined and communicated by the Organiser in its discretion.
7.7 If any provision contained in these Terms and Conditions is found to be invalid or unenforceable by any court, the invalid or unenforceable provision shall be severed or amended in such a manner as to render the rest of the provision(s) and remainder of these Terms and Conditions shall remain valid and enforceable.
7.8 Any failure or delay on the part of the Organiser to enforce any of these Terms and Conditions shall not constitute a waiver of any of its rights hereunder.
7.9 These Terms and Conditions may be subject to change from time to time. Please visit the Organiser’s website or its public announcement(s) from time to time for any updates.
7.10 Interpretation of any of these Terms and Conditions is the sole prerogative of the Organiser. All decisions by the Organiser regarding the interpretation of these Terms and Conditions and any issues arising from the Event shall be binding and conclusive on all Participants.
8. THIRD-PARTY RIGHTS
No third party will have any rights under the Contracts (Right of Third Parties) Ordinance (Cap.623) of the law of Hong Kong SAR to enforce or enjoy the benefit of any of these Terms and Conditions.
9. SEVERABILITY
If any provision of these Terms and Conditions is found to be invalid, illegal, or unenforceable, such provision shall be severed, and the remaining provisions shall continue in full force and effect.
10. ENTIRE AGREEMENT
These Terms and Conditions, together with any registration confirmation and additional terms posted publicly including but not limited on the Event website / application(s), constitute the entire agreement between the Organiser and Participants regarding the Event and supersede all prior negotiations, representations, and agreements (if applicable).
11. GOVERNING LAW
The Terms shall be interpreted and construed in accordance with the laws and regulations of the Hong Kong Special Administrative Region of the People’s Republic of China and any disputes shall be subject to the non-exclusive jurisdiction of the courts of Hong Kong.
In case of any discrepancy between the English and Chinese versions of these Terms and Conditions, the English version shall prevail.
