SPARK Lounge Terms and Conditions (“Terms”)

1. The SPARK Lounge is provided by Hong Kong Science & Technology Parks Corporation (“HKSTP”) and the same is available to SPARK members (“Members”) only. No non-members will be permitted to use the SPARK Lounge.
   
   
2. Access to the SPARK Lounge is granted by presenting a valid and registered SPARK membership. For the avoidance of doubt, access to the SPARK Lounge is always subject to HKSTP’s absolute discretion and HKSTP shall have the right refusing any persons to access the SPARK Lounge without the need of providing any reasons.
   
   
3. All Members access the SPARK Lounge must comply with all the Terms, each Member’s access to the SPARK Lounge will be terminated immediately if such Member fails to comply with any of the Terms. By entering the SPARK Lounge, each Member is deemed to have agreed with the Terms.
   
   

4. Opening hours of the SPARK Lounge: from 25 AUG 2023 to 20 OCT 2023 (only Mon to Fri except public holidays), 11:00 to 18:00
   
   

5. Location of SPARK Lounge: G/F Building 10W, Hong Kong Science Park.
   
   
6. Members can redeem daily perks (“Perks”) at SPARK Lounge, there are limited quantity and the Perks and the same will be distributed on first-come-first-served basis while stock lasts. Redemption of Perks may be subject to additional terms and conditions. Without prejudice to the generality of other provisions of the Terms, all Perks are distributed on an “as-is” basis without any warranties and no returns of exchanges of the same will be entertained.
   
   
7. No outside food or drinks are allowed in the SPARK Lounge.
   
   
8. Members are responsible for their own personal belongings while using the SPARK Lounge. HKSTP are not responsible for any lost or stolen items. HKSTP shall not be liable or responsible for any loss or damages caused to any Members.

9. HKSTP branded merchandise sales at SPARK Lounge (“HKSTP Merchandise”):
   
   
   1. Exchange Policy: All HKSTP Merchandise cannot be returned or exchanged with the exception of defective HKSTP Merchandise.  HKSTP shall have the absolute discretion to determine if any of the HKSTP Merchandise is defective. If any of the HKSTP Merchandise is defective, please inform the staff at the SPARK Lounge counter for assistance.
   2. Product Availability and Limitations: All HKSTP Merchandise available for sale at SPARK Lounge are limited in supply and HKSTP does not guarantee all HKSTP Merchandise will be available. 
   3. Pickup: All Purchasers of any HKSTP Merchandise must take delivery of the respective HKSTP Merchandise at SPARK Lounge immediately after payment.
   4. Payment methods: We accept a variety of payment methods including.

1. 1. 1. Credit Cards/ Debit Cards (Visa/ Master)
      2. HKSTP PAY (Only applicable to those customers who have completed the Palm Vein registration as the customer’s payment method)
      3. HKSTP App (QR code payment)

Note： Payment by cash is not accepted.

10. Each Member acknowledges and accepts that HKSTP is at liberty to make any changes or adjustments to the Terms from time to time without having to give any prior notice. In the event of any disputes arising out of the SPARK Lounge, HKSTP shall have the full and final say on all matters concerning the same.
    
    
11. HKSTP reserves the right to cancel or make changes to any part of the SPARK Lounge. In the event that activities of SPARK Lounge are cancelled for whatever reason, HKSTP shall not incur any liability towards any persons arising from such cancellations.
    
    
12. Without prejudice to the generality of other provisions of the Terms, all matters/activities in connection with the SPARK Lounge are provided “as is” without warranty of any kind, either express or implied.
    
    
13. All Members should consider the activities at the SPARK Lounge carefully and any Members should not participate or stop participate immediately when such Members have concern or appear that participation in any of the said activities will cause or is causing any health issues. Without prejudice to the generality of other provisions of the Terms, HKSTP shall not be responsible for any damages arise from or related to the said health issues.
    
    
14. Each Member acknowledges and agrees that HKSTP may use each Member’s likeness (including but not limited to photos and videos recorded in the Lounge) for the purpose of including the same in HKSTP’s promotional materials (including without limitation video, flyers and photos) without the need of (1) obtaining consent from any Member; and (2) providing any additional compensation to any Members. For the avoidance of doubt, any intellectual property rights of the said photos, videos and promotional materials shall belong to HKSTP solely.
    
    
15. If any provision contained in the Terms is found to be invalid or unenforceable by any court, the invalid or unenforceable provision shall be severed or amended in such a manner as to render the rest of the provision(s) and remainder of the Terms shall remain valid and enforceable.
    
    
16. The Terms shall be governed by and construed in accordance with the laws of the Hong Kong SAR and any disputes arising out of or in connection with this declaration shall be submitted to the exclusive jurisdiction of the courts of the Hong Kong SAR.
    
    
17. The Terms are not intended to be enforceable pursuant to the Contracts (Rights of Third Parties) Ordinance (Cap. 623 of the laws of Hong Kong).
