The below terms and conditions that apply to SPARK membership and SPARK Loyalty Programme
 
1. Definitions

"Information" refers to information, data, content, analysis, news, reports, programmes, photographs, pictures, graphics, video, audio, software and other materials and services, communications, transmissions and other items, tangible or intangible.
"Personal data" is personally identifying information or sensitive data (including but not limited to names, addresses, occupations, contacts, and other personal details).
“Hong Kong Science Park (HKSP)” or “SPARK” (an “Affiliate of HKSP”) includes "we", "our" or "us".
"Terms of Use" are the terms of use set forth below as amended from time to time.
"Users", "you" or "your" refer to any person who accesses the Website or SPARK members.
"Website" includes https://spark.hkstp.org and other website(s) from time to time hosted by Hong Kong Science and Technology Parks Corporation (HKSTP).
 “SPARK” Points or “Points” – means points awarded to you when you join events organised by SPARK

2. SPARK Membership

SPARK membership enrollment, which is processed through this Website, is restricted to persons who are lawful employees of HKSTP tenant companies within HKSP. SPARK enrollment is voluntary. By successfully signing up for SPARK and enjoying the use of SPARK’s services, including access of information on this Website, users are presumed to have read and accepted SPARK membership rules and regulations, which can be found below.
 
3. SPARK Membership Rules and Regulations

• Applicants must be a lawful employee of HKSTP tenant companies
• Applicants must complete all mandatory fields in the SPARK membership application form and applicants warrant and represent that the information provided in the application form is true, accurate and complete
• Membership is free of charge
• Once the member leave the tenant company or the tenant company move-out from Hong Kong Science Park, the membership will be terminated
• Each member will be issued with a SPARK membership card
• Each member will be issued with a SPARK ID and Password for accessing SPARK website
• All offers cannot be redeemed for cash and are non-exchangeable
• We reserve the right to alter the above rules and regulations, the offers and programmes without notice, other than by posting the revised offers, rules, regulations, programmes or arrangements on the SPARK website.
• We reserve the right to make the final and binding decision

4. SPARK Loyalty Programme

• All registered SPARK members are eligible to join “SPARK Loyalty Programme”
•  “SPARK” points will only be credited after membership application has been approved and the membership card has been issued
•  “SPARK” points may also be issued when members joined SPARK events or used the clubhouse facilities
• SPARK members can check and redeem their “SPARK” points in SPARK website (https://spark.hkstp.org)
• Earned “SPARK” points are valid until the SPARK membership is terminated
• We reserve the right to exclude any events or facilities booking from the calculation of “SPARK” points, in our absolute discretion. Number of “SPARK” points for each event or facilities booking will be shown in the SPARK website.
• We reserve the right to change the benefits, offers and features of the SPARK Loyalty Programme from time to time, without prior notice to you
• Upon accumulating the necessary amount of “SPARK” points, you may redeem your points for rewards.
• Rewards may be collected at clubhouse from time to time upon presentation of your SPARK card and a redemption confirmation provided by us when you choose to redeem your points.
• We give no warranty or representation in relation to any rewards, redemption products and / or services in connection with the SPARK Loyalty Programme or their suitability for any purpose. Any warranty claims in respect of any rewards, redemption products and / or services should be directed to the relevant manufacturer(s) and / or service provider(s).
• We shall not be liable for any loss of points or loss or damage suffered as a result of a technical defect or error that prevents us from retrieving information relating to your points balance from our computer system.
• Benefits, including “SPARK” points issued during one-off promotions will be governed by the rules applicable to the specific promotion, and may expire after the end of that promotion.
• You should notify us immediately if your SPARK card has been lost or stolen, or if you have reason to believe that your password may have been disclosed to an unauthorized party.
• It is your responsibility to ensure the safe custody and security of your membership card and password. We shall not be liable for any loss or damage suffered directly or indirectly as a result of and / or in relation to a lost or stolen membership card and / or the unauthorized disclosure of your password.
• In addition to your SPARK card, you may be required to present other identification for verification of your identity when you use your SPARK card.

5. Changes to Website

We may, in our sole discretion and at any time, without notice to you, add to, amend or remove any Information from the Website, or alter the presentation, substance, or functionality Changes.

6. User's Conduct

As a condition of your use of the Website, you must not: trespass, break into, access, use or attempt to trespass, break into, access or use any other parts of our servers, and/or any data areas for which you have not been authorised by us; restrict or inhibit any other user from using and enjoying the Website; post or transmit any unlawful, fraudulent, libellous, defamatory, obscene, pornographic, profane, threatening, abusive, hateful, offensive, or otherwise objectionable or unreasonable Information of any kind, including without limitation any transmissions constituting or encouraging conduct that may constitute a criminal offence, give rise to civil liability, or otherwise violate any local, state, national or foreign law; post or transmit any advertisements, solicitations, chain letters, pyramid schemes, investment opportunities or schemes or other unsolicited commercial communication, or engage in spamming or flooding; post or transmit any Information or software which contains any virus, Trojan horse, worm or other harmful component; post, publish, transmit, reproduce, distribute or in any way exploit any Information obtained through the Website for commercial purposes; or upload, post, publish, transmit, reproduce, or distribute in any way, Information obtained through the Website which is protected by copyright, or other proprietary rights, or create derivative works with respect thereto, without the prior written permission of the copyright owner or right-holder.
 
You have no rights in or to the Information available on the Website and you will not use the Information available on the Website in any manner or for any purpose, except as permitted under these Terms of Use.
 
7. Third Party Information

The Information may contain Information provided by Third Party Providers or sourced by HKSTP from other references or sources. The Information on the Website may not be regarded as any recommendation or endorsement by HKSTP for any purpose with respect to any person, product or service.
 
HKSTP is not responsible if any such Information is not up-to-date; HKSTP does not separately verify such Information. Accordingly we do not accept any responsibility whatsoever in respect of such Information. Any use of and reliance on such Information is at your own risk.
 
8. Links to and from the Website

The links on the Website may take you to other sites and you acknowledge and agree that HKSTP and the HKSTP Affiliates have no responsibility for the accuracy or availability of any Information provided by linked websites.
Links to other websites do not constitute an endorsement by HKSTP of such websites or the Information, products, advertising or other materials available on those websites.
 
9. Indemnity

You agree to defend, indemnify and hold us and the HKSTP Affiliates harmless from and against all liabilities, damages, claims, actions, costs and expenses (including without limitation legal fees), in connection with or arising from your breach of any of these Terms of Use and/or your use of the Website. We may, if necessary, participate in the defence of any claim or action and any negotiations for settlement. No settlement which may adversely affect our rights or obligations shall be made without our prior written approval. We reserve the right, at our own expense and on notice to you, to assume exclusive defence and control of any claim or action.
 
10. Intellectual Property Rights

All intellectual property rights subsisting in respect of the Website belong to HKSTP or have been lawfully licensed to HKSTP for use on the Website. All rights under applicable laws are hereby reserved. Except with the express permission of HKSTP, you are not allowed to upload, post, publish, reproduce, transmit or distribute in any way any component of the Website itself or create derivative works with respect thereto, as the Website is copyrighted under applicable laws.
 
You agree that we are free to use, disclose, adopt and modify all and any ideas, concepts, knowhow, proposals, suggestions, comments and other communications and information provided by you to us ("Feedback") in connection with the Website and/or Services without any payment to you. You hereby waive and agree to waive all and any rights and claims for any consideration, fees, royalties, charges and/or other payments in relation to our use, disclosure, adoption and/or modification of any or all of your Feedback.
 
11. Limited Liability and Warranty

All Information is for your general reference only. HKSTP do not accept any responsibility whatsoever in respect of such Information.
YOUR ACCESS TO AND USE OF OUR WEBSITE IS AT YOUR SOLE RISK AND IS PROVIDED "AS IS," "AS AVAILABLE." THE WEBSITE IS FOR YOUR PERSONAL USE ONLY AND WE MAKE NO REPRESENTATION OR WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING, WITHOUT LIMITATION, ANY WARRANTIES ON MERCHANTABILITY OR FITNESS FOR ANY PARTICULAR PURPOSE.

14. Governing Law and Jurisdiction

These Terms of Use shall be governed by the law of the Hong Kong Special Administrative Region. You agree to submit to the non-exclusive jurisdiction of the Hong Kong courts.
